CLASSIFICATION OF OFFENDERS

Sexual Predator - An offender convicted of a sexually violent offense, and who is likely to engage in the future in one or  more sexually oriented offenses, or with a sexually violent predator specification is automatically considered a sexual predator for registration and notification requirements.  However, for offenders not convicted with a sexually violent predator specification, the sentencing court shall determine whether the offender is a sexual predator.

Sexual Predators are required to verify address every ninety (90) days for life, or until a judge modifies or terminates the sexual predator designation, and are subject to neighbor/community notification provisions.

 

Habitual Sex Offender - In determining whether an offender convicted of one of the specified offenses is a habitual sex offender, the sentencing judge shall determine if the offender has previously been convicted of a sexually oriented offense.

Habitual Sex Offenders are required to verify address annually for twenty (20) years, and, at the sentencing judge's discretion, may be subject to neighbor/community notification provisions.

 

Sexually Oriented Offender - An offender who has been convicted of, or plead guilty to, a sexually oriented offense. 

Sexually Oriented Offenders are required to verify address annually for ten (10) years, and are not subject to neighbor/community notification provisions.

 

Habitual Child-victim Offender - An offender who has been convicted of, or plead guilty to, or is adjudicated a delinquent child for committing (on or after January 1, 2002) a child-victim oriented offense, when 14 years old or older at the time of committing the offense and is classified a Juvenile Offender based on that adjudication; and

The Offender was either:

          Previously convicted of or plead guilty to a child-victim oriented offense, or adjudicated a delinquent child for committing a child-victim oriented offense regardless of age and was classified a Juvenile Sex Offender or out-of-state Sex Offender registrant; or

          A delinquent child previously convicted of, plead guilty to or was adjudicated a delinquent child for committing a child-victim oriented offense regardless of when the offense was committed and regardless of the person's age at the time of committing the offense.

This class includes a person who has been convicted of, plead guilty to, or adjudicated a delinquent child for committing a child-victim oriented offense, and who, by virtue of the previous sex offenses now considered child-victim offenses, is automatically classified a Habitual Child-victim Offender pursuant to O.R.C. 2950.091 (E). 

A juvenile judge may later remove this classification from a delinquent child, pursuant to O.R.C. 2152.85.

 

Child-victim Predator - An offender who is either of the following:

          A person who was convicted of or plead guilty to a child-victim oriented offense and is adjudicated likely to engage in another offense in the future; or

          A person who was adjudicated a delinquent child for a child-victim oriented offense, and was 14 years old or older at the time of the offense, and was classified a Juvenile Sex Offender registrant and is adjudicated likely to engage in another offense in the future.
